Terms of Service

1. Acceptance of Terms
By accessing or using the Talknex platform, APIs, web interfaces, and related telephony services (collectively, the "Services"), provided by Talknex Technologies Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our Services.
2. Description of Service
Talknex provides a platform that allows businesses to create, deploy, and manage automated conversational AI agents. The Services enable inbound and outbound phone calls and SMS messaging through integrated third-party communication networks. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.
3. Acceptable Use Policy
When using our Services, you agree strict adherence to the following rules:
- Legal Compliance: You must comply with all applicable local, state, national, and international laws, including but not limited to the Telephone Consumer Protection Act (TCPA), GDPR, and CCPA.
- Consent: You are solely responsible for ensuring you have obtained explicit, legally valid consent from the recipient before initiating any outbound automated calls or SMS messages.
- Prohibited Content: You may not use the Services to transmit material that is illegal, harassing, defamatory, fraudulent, or otherwise objectionable.
- No Emergency Services: The Services are not intended to replace traditional landlines or mobile phones and do NOT support calls to emergency services (e.g., 911, 112).
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
5. Billing and Payment
Certain aspects of the Services are provided for a fee. You agree to pay all applicable fees related to your use of the Services as described in our pricing documentation. All fees are exclusive of applicable taxes. Telephony usage billing is calculated in discrete increments; partial minutes are billed as full minutes.
6. Limitation of Liability
To the maximum extent permitted by law, Talknex Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability arising out of or relating to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the liability.
7. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.
8. Governing Law & Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions. You and Talknex Technologies Inc. agree to submit to the exclusive jurisdiction of the courts located in Lahore, Pakistan to resolve any dispute arising from these Terms or the Services.
